Car Freedom Terms of Service

These Terms of Service ("Terms") are an agreement between you and Jamie Gray ("we," "us," or "Car Freedom"), which operates carfreedom.net (the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Summary

This summary is for convenience. The full Terms below control.

• Information only. Car Freedom is an information tool. It is not legal, tax, customs, or import advice. Verify everything before you buy, ship, or import a vehicle.
• Paid plans renew automatically. Plus and Premium renew monthly or yearly until you cancel.
• Cancel online anytime under Account → Manage subscription.
• Refunds: see Section 7.

1. The Service

Car Freedom publishes a catalog of vehicles sold outside the United States. It includes specifications, source-market prices, currency conversions, and notes on U.S. import rules, tariffs, and compliance. It also offers paid tools, such as landed-cost estimates, import scores, watchlists, alerts, and price history. Free features are available without a subscription. We may add, change, or remove features at any time. If we remove a core paid feature during a paid period, we will offer a prorated refund.

2. Not legal, tax, customs, or import advice

Everything on Car Freedom is general information for research. It is not legal, tax, customs, financial, or import advice, and it is not a quote. In particular:

• Import eligibility. Whether a vehicle can be imported is decided by the U.S. National Highway Traffic Safety Administration (NHTSA), the Environmental Protection Agency (EPA), U.S. Customs and Border Protection (CBP), and state motor-vehicle agencies. It depends on facts we do not know, and the rules change. Labels such as "25-year rule," "Tariff Prohibited," "import difficulty," or an import score are our summaries, not official determinations.
• Tariffs, duties, and taxes. Tariff rates, duties, fees, and taxes change often and depend on the vehicle, its origin, and its classification. Our figures may be out of date or wrong.
• Prices and exchange rates. Prices are collected from public sources, may be stale, and are converted using exchange rates as of the date shown. They do not include all shipping, compliance, brokerage, insurance, registration, or other costs. A landed-cost estimate is an estimate only.
• Third-party information. Specifications, photos, and news come from manufacturers and other third parties. We do not verify them.

Before you buy, ship, or import a vehicle, confirm the facts with the relevant government agencies, a licensed customs broker, and, where required, an NHTSA Registered Importer. You are responsible for your own decisions. We are not an importer, broker, dealer, or agent, and we do not sell vehicles.

3. Accounts

You must be at least 18 years old to create an account or subscribe. You sign in with a magic link sent to your email. Keep your email account secure, because anyone with access to it can sign in as you. You are responsible for activity on your account.

4. Plans and prices

Prices are in U.S. dollars. If sales tax or other tax applies to your purchase, it is calculated and shown at checkout before you pay. We show the price, billing period, and renewal terms before you pay. Payments are processed by Stripe. We do not store your full card number.

5. Automatic renewal

If you buy a paid plan, your subscription renews automatically at the end of each billing period (every month for monthly plans, every year for annual plans). We charge the then-current price for your plan to your payment method on file until you cancel. There is no minimum commitment beyond the period you have already paid for.

• Before you pay, we show the price, billing frequency, and how to cancel, and we ask you to agree to the automatic renewal.
• After you subscribe, we email you a confirmation that repeats these terms and explains how to cancel.
• Annual plans: we email you a reminder at least 15 days, and no more than 45 days, before each annual renewal. The reminder includes the renewal date, the price, and how to cancel.
• Price changes: we email you at least 30 days before a price increase applies to your subscription. The email explains how to cancel.
• At least once a year, we remind you of your subscription terms and how to cancel.

6. How to cancel

You can cancel online at any time. Go to Account → Manage subscription → Cancel plan. This opens our secure billing portal, which Stripe provides. You do not need to call or email anyone. If you cannot cancel online, email legal@carfreedom.net, and we will cancel the same business day.

When you cancel, you keep paid features until the end of the period you already paid for, and you will not be charged again. Your account then returns to the Free plan.

7. Refunds

• Monthly plans: you can cancel anytime to stop future charges. We do not give refunds or credits for partial months, except where the law requires them.
• Annual plans: if you cancel within 14 days after your first annual charge, or after any annual renewal charge, you can ask for a full refund of that charge. After that, we do not refund the unused part of the year, but you keep access until the year ends.
• Billing errors: we will refund duplicate charges, charges made after you cancelled, and other charges made in error.
• How to ask: email legal@carfreedom.net from your account email. We send approved refunds to your original payment method within 10 business days.

If you file a chargeback instead of contacting us, we may suspend your account while the dispute is open.

8. Acceptable use

Do not:

• scrape, bulk-download, or resell the catalog, prices, or analysis without our written permission;
• share your account or paid features with others;
• get around paywalls or rate limits;
• interfere with or probe the security of the Service; or
• use the Service for any unlawful purpose.

9. Content and intellectual property

We or our licensors own the Service, including its software, design, compilations, scores, and analysis. Vehicle names, logos, and photos belong to their owners. We use them to identify vehicles, and their use does not imply endorsement. News headlines link to their original publishers.

If you believe content on the Service infringes your copyright, email legal@carfreedom.net with the information listed in 17 U.S.C. § 512(c)(3). That information is:

• your signature;
• the work you claim is infringed;
• the material and its location on the Service;
• your contact information;
• a good-faith statement; and
• a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY VEHICLE CAN BE LAWFULLY IMPORTED, REGISTERED, OR DRIVEN IN THE UNITED STATES, OR THAT ANY PRICE, TARIFF, OR COST ESTIMATE IS CORRECT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, OR FOR LOSSES FROM BUYING, SHIPPING, IMPORTING, OR FAILING TO IMPORT ANY VEHICLE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE WAIVED UNDER THE TEXAS DECEPTIVE TRADE PRACTICES ACT OR OTHER CONSUMER-PROTECTION LAWS.

12. Indemnity

You agree to indemnify us against third-party claims arising from your misuse of the Service or your violation of these Terms, except to the extent the law prohibits it.

13. Termination

You may stop using the Service at any time, and you may delete your account by emailing legal@carfreedom.net from your account email. We may suspend or terminate accounts that violate these Terms. If we terminate a paid account without cause, we will refund the unused part of your current paid period.

14. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Tarrant County, Texas, and you and we consent to jurisdiction there. Either of us may bring an individual claim in small claims court. Before filing a claim, please email legal@carfreedom.net and give us 30 days to try to resolve it.

15. Changes

We may update these Terms. For material changes, we will notify subscribers by email at least 30 days before the change takes effect. Price changes follow Section 5. If you continue to use the Service after a change takes effect, you accept the updated Terms.
